How a civil case usually moves

Most civil disputes follow the Code of Civil Procedure, 1908. A typical path is: a legal notice, filing of the plaint with documents, service of summons, written statement by the other side, framing of issues, evidence, final arguments and judgment. Interim relief, such as a stay or temporary injunction, can be sought at the start when the matter is urgent.

Why timing matters

The Limitation Act, 1963 fixes deadlines for filing most civil suits; many money claims must be filed within three years. Commercial disputes of specified value generally require pre-institution mediation under Section 12A of the Commercial Courts Act before a suit is filed, unless urgent interim relief is needed. Getting advice early keeps your options open.

Frequently asked questions

Which court will hear my civil case in Delhi?

It depends on the value of the claim and the place where the cause of action arose or the defendant resides. Lower-value suits go to the District Courts; high-value suits can lie on the original side of the Delhi High Court.

Can I get a stay or injunction quickly?

Yes, courts can grant temporary injunctions at the first hearing in urgent cases, if you show a prima facie case, balance of convenience and irreparable harm.

Do I need to send a legal notice first?

Not always, but a well-drafted legal notice often resolves the dispute or strengthens your record. For suits against the government, notice under Section 80 CPC is generally required.
